Welcome to the DanceSmart Business Solutions Toolkit (the "Toolkit"), provided by DanceSmart (referred to as "we", "our", "us"). These Terms of Use ("Terms") govern your access to and use of the Toolkit. By purchasing, downloading, and/or using the Toolkit, you agree to comply with and be bound by these Terms. If you do not agree to these Terms, you must not access or use the Toolkit.

1. License to Use

Upon purchase, DanceSmart grants you a non-exclusive, non-transferable, revocable license to download, access, and use the Toolkit for your personal or business use. This license is subject to these Terms and does not grant you ownership of the Toolkit.

2. Permitted Use

You may use the Toolkit solely for:

  • Running or managing your dance business.

  • Creating and implementing marketing materials, business plans, and financial strategies.

  • Organising classes, performances, and related operations.

  • Using the Toolkit's templates and resources for personal or internal business use.

3. Prohibited Use

You may not:

  • Resell, distribute, sublicense, or otherwise transfer any part of the Toolkit to third parties.

  • Use the Toolkit in any manner that violates applicable laws, infringes upon any intellectual property rights, or otherwise harms others.

4. Intellectual Property Rights

The Toolkit is protected by copyright, trademark, and other intellectual property laws. All content, including text, images, templates, and resources, is the exclusive property of DanceSmart. You acknowledge that no rights, title, or interest in or to the Toolkit, other than those expressly granted in these Terms, are transferred to you.

5. Payment & Access

By purchasing the Toolkit, you agree to pay the stated price. Upon successful payment, you will be granted access to a digital download of the Toolkit. Access to the Toolkit is granted immediately upon payment, and no refunds will be provided once the download has been initiated.

6. Account Creation

You may be required to create an account in order to access the Toolkit. You agree to provide accurate, current, and complete information during the registration process and to maintain the confidentiality of your account credentials. You are responsible for all activities under your account.

7. Limitations of Liability

To the fullest extent permitted by law, DanceSmart shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the Toolkit. This includes but is not limited to damages for loss of profits, data, or business interruption.

8. No Warranties

The Toolkit is provided "as is" without warranties of any kind, either express or implied, including but not limited to the implied warranties of merchantability or fitness for a particular purpose. We do not guarantee that the Toolkit will meet your specific requirements or be free of errors, interruptions, or defects.

9. Termination

We may terminate your access to the Toolkit if you violate any of these Terms. Upon termination, you must immediately cease using the Toolkit and delete all copies from your devices.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of Australia, without regard to its conflict of law principles. Any legal action or proceeding related to these Terms shall be brought exclusively in the courts located in Australia.

11. Changes to the Terms

We reserve the right to modify, amend, or update these Terms at any time. Any changes will be effective immediately upon posting to our website or notifying you. Your continued use of the Toolkit after such changes will constitute your acceptance of the revised Terms.
